Termination by ChainWatchX

Effect of Termination

Upon termination:

Immediate Effects:

• Your access to the Service will cease immediately
• All monitoring and alerting will stop
• Your license to use our software is revoked
• You must cease all use of our intellectual property

Data Handling:

• You have 30 days to export your data
• We will delete your account data after 30 days
• Some data may be retained for legal compliance
• Anonymized data may be retained for service improvement

Refunds Upon Termination

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

Jurisdiction

Any legal action or proceeding relating to these Terms shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you consent to the jurisdiction of such courts.

Dispute Resolution Process

Before initiating any formal dispute resolution, you agree to first contact us at legal@chainwatchx.com to attempt to resolve the matter informally.

Step 2: Mediation (Optional)

If direct communication doesn't resolve the dispute, either party may request mediation through a mutually agreed mediator.

Step 3: Binding Arbitration

If mediation fails or is declined, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Exceptions to Arbitration

Either party may seek court relief for:

• Intellectual property infringement claims
• Preliminary injunctive relief
• Small claims court matters (under $10,000)
• Emergency relief to prevent irreparable harm

Statute of Limitations

Any claim or dispute must be filed within one (1) year after the claim arises, or it will be permanently barred.

International Users

For users outside the United States, these Terms shall be governed by California law, but local mandatory consumer protection laws may also apply. In case of conflict, the more protective provisions for consumers shall prevail.
